You are receiving this notice because you have been identified in KeyBank’s investigation as one of the 97,982 persons who were included in the subject inquiry to Equifax as a result of a computer coding error after you paid off debt owed to KeyBank. You may be entitled to benefits under this class action settlement.

YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT

YOU MAY SUBMIT A CLAIM FORM

To receive a pro rata share of the Settlement, you must submit a Claim Form and follow all of the instructions on the Claim Form.  You must sign (physically or electronically) the Claim Form, and the Claim Form must be postmarked or submitted through this website no later than June 7, 2019.

YOU MAY EXCLUDE YOURSELF

To be excluded from the Settlement, you must mail a request for exclusion by U.S. first class mail to Detter v. KeyBank Settlement Administrator, P.O. Box 404126, Louisville, KY 40233-4126, which must be postmarked on or before June 7, 2019.  Your request must state your name, address, and that you want to opt out of the Settlement or otherwise do not want to participate in the Settlement.

YOU MAY OBJECT

If you wish to object to the Settlement, you must file a timely written statement of objection with the Clerk of Court, and mail a copy of that objection to Class Counsel and Counsel for KeyBank. This mailing must be postmarked no later than June 3, 2019. Filing an objection in accordance with the terms of the Settlement Agreement is the only way you will be permitted to contest the approval of the Settlement or the Court’s Order of Final Approval.

YOU MAY ATTEND A HEARING

If you object to the Settlement, you may also ask to speak in Court about the fariness of the Settlement.

YOU MAY DO NOTHING

If you do nothing, you will receive no payment under the Settlement, but you will be bound by its terms if approved and give up your rights to sue KeyBank about the issues in this case.
